Terms of Service

By accessing, installing, or using the VoiceOI platform (the "Service"), provided by Gixiai ("we," "us," or "our"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the "Client" or "User") and Gixiai. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

We reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Service after such changes constitutes acceptance of the new Terms.

The Service is designed to provide orchestration for AI-powered voice agents. You agree to use the Service in strict compliance with all applicable local, state, federal, and international laws, including but not limited to:

• The Telephone Consumer Protection Act (TCPA) and its regulations.
• The Telemarketing Sales Rule (TSR).
• Payment Card Industry Data Security Standard (PCI DSS).
• General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA).

UNAUTHORIZED USE PROHIBITED: You are strictly prohibited from using VoiceOI for illegal "robocalling," harassment, fraud, or any activities that violate the "Do Not Call" registry or local telecommunications laws. Violation of this clause will result in immediate termination of service without refund.

Your subscription plan dictates the maximum number of concurrent bot nodes and concurrent calls allowed. Any attempt to bypass these technical limitations through unauthorized modifications to the Bot Node software or API spoofing is a breach of this agreement.

Gixiai does not guarantee 100% uptime of third-party integrations (e.g., VICIdial, Twilio, OpenAI). Service performance may be affected by the Client's choice of hosting environment and network bandwidth.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIXIAI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Gixiai is a technical facilitator of voice AI orchestration. We do not control the content of the scripts you deploy or the nature of the calls made. You assume full legal responsibility for all voice interactions conducted through the Service. You agree to indemnify and hold harmless Gixiai from any legal claims, fines, or damages arising from your use of the Service in violation of any law.

The VoiceOI software, including the Master Server logic, Bot Node executables, and the Dashboard UI, are the exclusive property of Gixiai. You are granted a limited, non-exclusive, non-transferable license to use the Service for the duration of your subscription. Reverse engineering or redistribution of our proprietary logic is strictly prohibited.

User Content: You retain all rights to the scripts, prompts, and lead data you upload to the Master Server. Gixiai does not claim ownership of your data but requires a license to process this data solely to provide the Service.

6. Termination

You may cancel your subscription at any time through the dashboard. Gixiai reserves the right to suspend or terminate accounts that facilitate illegal activity, fail to pay subscription fees, or provide false registration information.
